NOTICE OF THE PASSING OF A ZONING BY-LAW BY
THE CORPORATION OF THE TOWNSHIP OF LAURENTIAN VALLEY

TAKE NOTICE that the Council of the Corporation of the Township of Laurentian Valley passed

By-Law No. 2021-02-004 on the 16th day of February, 2021, under Section 34 of the Planning Act, R.S.O. 1990, c.P.13.

PURPOSE, EFFECT & LOCATION OF ZONING BY-LAW AMENDMENT (File No. Z-2021-01)

The purpose of the amendment is to rezone the subject lands to satisfy a condition of consent for Application for Consent File No.B6/20, which would allow an existing farmer who resides on another farm property to acquire the larger farm lot, leaving the surplus existing residential dwelling known municipally as 1351 Ross Road as the retained lot in the Consent application.  The condition on the consent is to address the requirements of the Official Plan and the PPS restricting new residential lots in prime agriculture areas. Residential uses on the severed lot are to be prohibited, however the lands will continue to be used for agricultural purposes by the area farmer.

The effect of the amendment is to rezone the proposed severed lot from Agriculture (A) to Agriculture-Exemption Twenty-Four (A-E24) and to amend the provisions of the Agriculture-Exception Twenty-Four (A-E24) zone to include a legal description of the severed lot as the existing A-E24 zone already prohibits residential uses.

The lands affected by the Amendment are located on Ross Road and Stafford Second Line in Part Lot 6, Concession 2, in the geographic Township of Stafford, in the Township of Laurentian Valley, as shown on the Key Map.

EFFECT OF PUBLIC CONSULTATION ON DECISION

No written submissions were received and no oral submissions were made at the Public Meeting by members of the Public and no written submissions were received from Public Agencies that would affect the decision of Council.

AND TAKE NOTICE that any individual, corporation or public body may appeal to the Local Planning Appeal Tribunal (LPAT) in respect of the By-law by filing no later than 4:00 p.m. on the 10th day of March, 2021, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $300.00 payable to the Minister of Finance by certified cheque or money order.  The appeal must also be accompanied by the completed LPAT appeal form.  If you wish to appeal to the Local Planning Appeal Tribunal (LPAT), a copy of an appeal form is available from the Tribunal website at http://elto.gov.on.ca/tribunals/lpat/forms/ or by contacting the Township.

A COPY of the proposed amendment, material provided under Section 34 (10.1) of the Planning Act and any additional information relating to the proposed Zoning By-law Amendment (Application File No. Z-2021-01), is available by contacting the Township office at 613-735-6291 during regular office hours or by emailing nsargent@lvtownship.ca quoting File No. Z2021-01 and arrangements will be made to provide you with a copy of any requested materials by mail or email or due to COVID-19 measures, by arranging a special appointment if necessary at the Township office.  Questions related to the application should be directed to Lauree Armstrong, Township Planner or Navada Sargent, Planning Administrative Clerk.

Only individuals, corporations and public bodies may appeal a by-law to the Local Planning Appeal Tribunal (LPAT).  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
