NOTICE OF INTENTION TO PASS AMENDING BY-LAW TO REMOVE HOLDING (- h) SYMBOL

TAKE NOTICE that pursuant to the provisions of Sections 34 and 36 of the Planning Act, R.S.O. 1990, c.P.13, at a Meeting to be held on TUESDAY, JANUARY 19th, 2021 at 5:30 p.m. Council of the Corporation of the Township of Laurentian Valley intends to pass an Amending By-law to Comprehensive Zoning By-law No. 08-04-391 to remove a holding symbol from the zoning on certain lands.

AS THIS WILL BE AN ELECTRONIC PUBLIC MEETING WHERE THERE WILL BE NO PHYSICAL IN PERSON ATTENDANCE DUE TO COVID-19, THERE WILL BE OPPORTUNITIES PROVIDED TO WATCH THE MEETING LIVE AND PROVIDE INPUT ELECTRONICALLY, AS WELL AS, A VARIETY OF OTHER OPPORTUNITIES TO SUBMIT YOUR COMMENTS, PRIOR TO THE MEETING, SO THAT THEY CAN BE CONSIDERED BY COUNCIL PRIOR TO A DECISION BEING MADE ON THE APPLICATION.

PURPOSE, EFFECT & LOCATION OF ZONING BY-LAW AMENDMENT (Application File No. Z-2020-12)

The purpose of the amendment is to pass a by-law to remove the holding symbol and authorize the conversion of two existing buildings for use as a retail store for sale of motorcycles, motorbikes, motorized bicycles and bicycles, cycling related products, sporting equipment, motorcycle and bicycle repair, on the subject property.  The property was previously rezoned to a Rural-Exception Sixty-Four-holding (RU-E64-h) zone which established the principle of development.  The holding zone was put in place to provide a tool where the Township could ensure that certain conditions were met prior to the change in use being fully authorized on the site.  The conditions for removal of the holding zone have now been met and included the submission of a Site Plan and the entering into of a Site Plan Agreement with the Township that has been registered on title which includes a clause wherein the Owner has acknowledged and agreed that active recreation uses are not permitted on the property.  The remaining conditions that have been addressed include: that safe and adequate access points have been provided to the satisfaction of the County of Renfrew and the Township; adequate water services and septic or any other required utilities are available or will be provided; and a Stormwater Management Plan has been provided to the satisfaction of the Township and the County of Renfrew and forms part of the Site Plan Agreement.  Once Council makes passes a by-law to remove the holding symbol that decision will be final as there is no opportunity for the public to appeal the decision as that ability was provided when the initial rezoning was passed that established the principle of development.

The effect of the amendment is to rezone the subject lands from Rural-Exception Sixty-Four-holding (RU-E64-h) to Rural-Exception Sixty-Four (RU-E64).

The lands affected by this amendment are located on 499 TV Tower Road Road in Part of Lot 33 &34, Concession A, in the geographic Township of Alice, in the Township of Laurentian Valley, as shown on the Key Map.

Additional information will also be posted on the Township website.

ANY PERSON may participate in the public meeting and/or make written or verbal representation either in support of or in opposition to the proposed amendment.  As a result of COVID-19 you are strongly encouraged to contact the Township if you have any questions and either provide written or verbal comments to Township Staff prior to the Public Meeting.  To ensure that your comments are clearly understood and received prior to Council making a decision, you are strongly encouraged to submit comments prior to the Public Meeting even if you intend to provide verbal comments at the electronic Public Meeting.  Instructions on how to connect to the electronic public meeting will be available closer the Meeting date and you will be able to find that information out by checking the Council Agenda for the January 19th, 2021 Council meeting on the Township website or by contacting the Township office at 613-735-6291 or at info@lvtownship.ca requesting information on how to access the January 19th, 2021 Meeting. It is strongly encouraged that you speak with Township staff prior to the meeting if you intend to provide verbal comments during the meeting.
