NOTICE OF THE PASSING OF A ZONING BY-LAW BY

THE CORPORATION OF THE TOWNSHIP OF LAURENTIAN VALLEY

TAKE NOTICE that the Council of the Corporation of the Township of Laurentian Valley passed

By-Law No. 2017-03-011 on the 21st day of March, 2017, under Section 34 of the Planning Act, R.S.O. 1990, c.P.13.

PURPOSE AND EFFECT OF ZONING BY-LAW AMENDMENT (File No. Z-2017-02)

The purpose of the amendment is to permit a maximum of nine (9) seacans/shipping containers to be used for commercial storage on the subject property which is limited to a maximum of three (3) by the General Provisions of the Zoning By-law. The existing use of the property is for an automobile vehicular sales or rental establishment and the property is subject to an existing site plan agreement. A concurrent request to amend the Site Plan Agreement has been filed being File No. SP2017 01.

The effect of the amendment is to rezone the subject property from Highway Commercial (HC) to Highway Commercial-Exception Twenty-Seven (HC-E27) and establish a special provision in the HC-E27 zone permitting a maximum of nine (9) seacans/shipping containers used for commercial storage to be located on the property.

EFFECT OF PUBLIC CONSULTATION ON DECISION

All written and oral submissions received on the application were considered in the decision-making process and no changes were made to the By-law as originally proposed. The only exception required was to the maximum number of seacans/shipping containers to be used for commercial storage on the property and all other provisions of the Zoning By-law will be met.

LOCATION OF SUBJECT LANDS

The lands affected by the Amendment are 1406 Pembroke Street West (County Road 51), in Part 1, Plan 49R-14292, Part Lot 36, Concession A, geographic Township of Alice, in the Township of Laurentian Valley as shown on the Key Map.

AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing no later than 4:00 p.m. on Wednesday the 12th day of April, 2017, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $300.00 payable to the Minister of Finance by certified cheque or money order. The appeal must also be accompanied by the completed OMB appeal form. If you wish to appeal to the Ontario Municipal Board, a copy of an appeal form is available from the OMB website at www.omb.gov.on.ca or by contacting the Township.

A COPY of the amendment and any additional information relating to the Zoning By-law Amendment, is available for inspection during office hours at the Township Office. Any questions related to the By-law should be directed to Lauree Armstrong, Township Planner.

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
