NOTICE OF THE PASSING OF A ZONING BY-LAW BY

THE CORPORATION OF THE TOWNSHIP OF LAURENTIAN VALLEY

 

TAKE NOTICE that the Council of the Corporation of the Township of Laurentian Valley passed

By-Law No. 2017-03-010 on the 21st day of March, 2017, under Sections 34 and 36 of the Planning Act, R.S.O. 1990, c.P.13.

PURPOSE AND EFFECT OF ZONING BY-LAW AMENDMENT (Application File No. Z-2017-01)

The purpose of the amendment is to permit a maximum of three accessory dwelling units on a property that may also be used for commercial purposes in accordance with the uses permitted in the Highway Commercial (HC) zone. The effect is to rezone the subject lands from Highway Commercial (HC) to Highway Commercial-Exception Twenty-Six-holding (HC-E26-h) and establish special provisions for the HC-E26 zone which permit a maximum of three (3) accessory dwelling units and recognize the existing setbacks of the existing buildings. A corresponding application for Site Plan Approval is also being processed by the Township.

EFFECT OF PUBLIC CONSULTATION ON DECISION

All written and oral submissions received on the application were considered in the decision-making process. In order to address comments received from the Ministry of Transportation (MTO) requiring a second entrance to be removed as a condition of the rezoning, a holding zone was added to the rezoning for the property. The holding zone will allow the principle of development for the property to be established through the rezoning to HC-E26-h, but a building permit cannot be issued until the condition is met as established by the corresponding resolution passed by Council and the holding symbol is lifted.

LOCATION OF SUBJECT LANDS

The lands affected by the Amendment are located at 1200 Pembroke Street East (Provincial Highway 148), in Lot 22, Plan 413, within Part Lot 19, Concession 2 F.A.L., geographic Township of Pembroke, in the Township of Laurentian Valley, as shown on the Key Map.

AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing no later than 4:00 p.m. on Wednesday the 12th day of April, 2017, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $300.00 payable to the Minister of Finance by certified cheque or money order. The appeal must also be accompanied by the completed OMB appeal form. If you wish to appeal to the Ontario Municipal Board, a copy of an appeal form is available from the OMB website at www.omb.gov.on.ca or by contacting the Township.

A COPY of the amendment and any additional information relating to the Zoning By-law Amendment, is available for inspection during office hours at the Township Office. Any questions related to the By-law should be directed to Lauree Armstrong, Township Planner.

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
