NOTICE OF APPLICATIONS FOR OFFICIAL PLAN AND ZONING BY-LAW AMENDMENTS
AND NOTICE OF PUBLIC MEETING

TAKE NOTICE that pursuant to the requirements of Sections 22(6.4) and 34(10.7) of the Planning Act, RSO 1990, c.P.13, as amended, the Corporation of the Township of Laurentian Valley advise that applications for amendment to the Official Plan of the Township of Laurentian and for amendments to Comprehensive Zoning By-law No. 08-04-391 of the Township of Laurentian Valley have been received and were deemed to be complete applications pursuant to the requirements of the Planning Act.

AND FURTHER, TAKE NOTICE that the Township of Laurentian Valley will hold a PUBLIC MEETING ON TUESDAY JANUARY 22nd, 2013, at 5:30 p.m. at the Township Municipal Office at 460 Witt Road, to consider the proposed amendments to the Official Plan of the Township of Laurentian Valley and Comprehensive Zoning By-law No. 08-04-391 of the Township of Laurentian Valley. The amendments have been prepared in accordance with the provisions of Sections 17, 21, 22, 34 and 36 of the Planning Act, R.S.O. 1990, c.P.13, as amended.

Item 1:
PURPOSE AND EFFECT OF OFFICIAL PLAN AMENDMENT NO. 10 (File No. O-2012-01)
The purpose of proposed OPA No. 10 to the Official Plan of the Township of Laurentian Valley is to redesignate lands in order to permit their use for aggregate extraction. The effect of this amendment is to redesignate lands from “Rural” to “Mineral Aggregate Resource” on Schedule ‘A-1’(Alice) of the Official Plan. An application for licence under the Aggregate Resources Act to operate a gravel pit on the property is also being filed with the Ministry of Natural Resources. Concurrent amendments to the Comprehensive Zoning By-law are being processed by the Township which also affect the subject property, including portions already designated Mineral Aggregate Resource where an amendment to the Zoning By-law is also required, as described in more detail in Item 2. below. It should be noted that there are additional lands nearby that are owned by the same property owner, where the same licensee is also applying for a license for a gravel pit in a concurrent application for zoning by-law amendment as described in Item 3 below.

Item 2:
PURPOSE AND EFFECT OF ZONING BY-LAW AMENDMENT (Application File No. Z-2012-12)
The purpose of the proposed amendments to Comprehensive Zoning By-law No. 08-04-391, are to rezone lands to permit their use for aggregate extraction, in association with a corresponding application for Aggregate Licence from the Ministry of Natural Resources and an amendment to the Official Plan as described above. The effect of the amendment is to rezone lands from “Rural (RU)”, “Extractive Industrial (EM)”, “Extractive Industrial-holding (EM-h)” and “Extractive Industrial Reserve (EMR)” to “Extractive Industrial-Exception Six-holding (EM-E6-h)”, and to establish an EM-E6 zone with special provisions that provide for a reduction in the 22 metre setback for extraction from a street line to 15 metres for the boundary with Derions Road and from 30 metres to 15 metres where the lands abut lands in a zone other than an Industrial zone. The exception will also allow for the use of material to be extracted from within the area adjacent to Derions Road, in order to allow for the material to be used for potential works related to Derions Road. The holding symbol would remain in place until such time as the Township is notified by the Ministry of Natural Resources that the Aggregate Licence has been approved by MNR staff and any other conditions for removal of the holding symbol as identified by resolution of Council have been met.

LOCATION OF LANDS AFFECTED BY ITEMS 1 AND 2
The lands affected by OPA No.10 (Application O-2012-01) and the corresponding Zoning By-law Amendment (Application No. Z-2012-12) are located on Zanders Road and Derions Road, within Part Lot 15, Concession 7, in the geographic Township of Alice, in the Township of Laurentian Valley, as shown as Items 1 and 2 on the Key Map.

Item 3:
PURPOSE AND EFFECT OF ZONING BY-LAW AMENDMENT (Application File No. Z-2012-13)
The purpose of the proposed amendments to Comprehensive Zoning By-law No. 08-04-391, are to rezone lands to permit their use for aggregate extraction, in association with a corresponding application for Aggregate Licence from the Ministry of Natural Resources. The effect of the amendment is to rezone lands from “Extractive Industrial Reserve (EMR)” to “Extractive Industrial-Exception Seven-holding (EM-E7-h)” and establish special provisions for the EM-E7 zone that provide for a reduction in the 22 metre setback for extraction from a street line to 0 metres for the boundary with Zanders Road and from 30 metres to 0 metres where the lands abut lands zoned Rural (RU) and located on the same property. The holding symbol would remain in place until such time as the Township is notified by the Ministry of Natural Resources that the Aggregate Licence has been approved by MNR staff and any other conditions for removal of the holding symbol as identified by resolution of Council have been met.

LOCATION OF LANDS AFFECTED BY ITEM 3
The lands affected by Zoning By-law Amendment (Application No. Z-2012-13) are part of a larger property located on Zanders Road (known municipally as 1072 Zanders Road) within Part Lots 16, 17, and 18, Concession 7, in the geographic Township of Alice and are more specifically, within Part Lot 17, Concession 7, in the geographic Township of Alice, in the Township of Laurentian Valley, as shown as Item 3 on the Key Map.

COPIES of the proposed amendments, material provided under Sections 22(4) and 34 (10.1) of the Planning Act and any additional information relating to the proposed Official Plan Amendment OPA #10 (Application File No. O-2012-01) and Zoning By-law Amendments (Application File No.s Z-2012-12 and Z-2012-13), are available for inspection during regular office hours at the Township Office. Questions related to the application should be directed to Lauree Armstrong, Township Planner.

ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of or in opposition to the amendments aforesaid. If a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Laurentian Valley before the by-law is passed or the County of Renfrew before a decision is issued on the proposed Official Plan Amendment, the person or public body is not entitled to appeal the decision of the Township of Laurentian Valley or the County to the Ontario Municipal Board. If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Township of Laurentian Valley before the by-law is passed or the County of Renfrew before a decision is issued on the proposed Official Plan Amendment, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.
