NOTICE OF THE PASSING OF A ZONING BY-LAW BY
THE CORPORATION OF THE TOWNSHIP OF LAURENTIAN VALLEY
 
TAKE NOTICE that the Council of the Corporation of the Township of Laurentian Valley passed
By-Law No. 2018-07-036 on the 24th day of July, 2018, under Sections 34 and 36 of the Planning Act, R.S.O. 1990, c.P.13.
 
PURPOSE, EFFECT & LOCATION OF ZONING BY-LAW AMENDMENT (Application File No. Z-2018-07)
The purpose of the amendment is to rezone lands to permit the construction of a coach house type of secondary dwelling unit on lands that are within 120 metres of Provincially Significant Wetland (PSW) and which are subject to the Natural Heritage Feature (NHF) Zone provisions.  The subject lot has an existing primary residential single detached dwelling and a coach house is proposed which is defined as “a secondary dwelling unit that is a separate dwelling unit detached from a primary dwelling unit and is located in its own building and on the same lot as the primary dwelling unit.”  In support of the application, an Environmental Impact Study (EIS) was prepared by a qualified biologist to confirm that it would be possible to construct the coach house on lands that are within 120 metres of the PSW and have no negative impacts on the natural features or ecological functions for which the area is identified..
 
The effect of the amendment is to establish a Residential One-Exception Thirty-Six (R1-E36) zone with special provisions which permit a coach house to be constructed within the 120 metre buffer from the edge of a PSW.  The amendment would also rezone the subject lands from Residential One-Exception One (R1-E1) to Residential One-Exception Thirty-Six (R1-E36).
 
The lands affected by the Amendment are located at 269 Hazley Bay Road, being Lot 16, Plan 499, within Part Lot 4, Concession 2, geographic Township of Pembroke, in the Township of Laurentian Valley, as shown on the Key Map.
 
EFFECT OF PUBLIC CONSULTATION ON DECISION
Oral submissions were made at the Public Meeting by members of the Public and were considered by Council prior to a decision being made. No written submissions were received from the public.  No written submissions were received from Public Bodies other than comments indicating no objections.  The consideration of the comments did not change the content of the by-law which was passed as originally proposed.)
 
AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing no later than 4:00 p.m. on the 14th day of August, 2018, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $300.00 payable to the Minister of Finance by certified cheque or money order.  The appeal must also be accompanied by the completed LPAT appeal form.  If you wish to appeal to the Local Planning Appeal Tribunal (LPAT), a copy of an appeal form is available from the Tribunal website at www.elto.gov.on.ca or by contacting the Township.
 
A COPY of the amendment and any additional information relating to the Zoning By-law Amendment, is available for inspection during office hours at the Township Office.  Any questions related to the By-law should be directed to Lauree Armstrong, Township Planner.
 
Only individuals, corporations and public bodies may appeal a by-law to the Local Planning Appeal Tribunal (LPAT).  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
 
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
