NOTICE OF APPLICATION FOR ZONING BY-LAW AMENDMENT
AND NOTICE OF PUBLIC MEETING

TAKE NOTICE that pursuant to the requirements of Section 34(10.7) of the Planning Act, R.S.O. 1990, c.P.13, as amended, the Corporation of the Township of Laurentian Valley advises that an application for amendment to Comprehensive Zoning By-law No. 08-04-391 of the Township of Laurentian Valley has been received and was deemed to be a complete application pursuant to the requirements of the Planning Act.  AND FURTHER, TAKE NOTICE that the Corporation of the Township of Laurentian Valley will hold a PUBLIC MEETING ON TUESDAY, JUNE 5th, 2018 at 5:30 p.m. at the Township Municipal Office at 460 Witt Road, to consider the proposed amendment to Comprehensive Zoning By-law No. 08-04-391 of the Township of Laurentian Valley.  The amendment has been prepared in accordance with the provisions of Sections 34 and 36 of the Planning Act.

PURPOSE & EFFECT OF ZONING BY-LAW AMENDMENT (File No. Z-2018-05)

The purpose of the amendment is to rezone lands to permit the construction of a single detached residential dwelling closer to lands zoned Extractive Industrial Reserve (EMR) than the general provisions of the Zoning By-law currently permit.  The subject lot is an existing 4046.86 square metre (1 acre) lot of record where it would not be possible to construct a dwelling and meet the minimum setback from EMR. The effect of the amendment is to establish a Rural-Exception Seventy-Five (RU-E75) zone with special provisions which permit a single detached dwelling to be constructed with a minimum setback of 23 metres from an Extractive Industrial Reserve (EMR) zone.  The amendment would also rezone the subject lands from Rural (RU) to Rural-Exception Seventy-Five-holding (RU-E75-h). The holding zone will establish the principle of development for the property but will remain in place until the conditions for removal of the holding symbol as established by resolution of Council have been met.  The conditions would include the entering into of an Agreement with the Township to be registered on title to advise future purchasers of the potential for impacts from future aggregate operations in the area including noise, dust and vibration.  The lands affected by the Amendment are located on Schwartz Road, being Part 1, Plan 49R-2174, within Part Lot 1, Concession 8, geographic Township of Alice, in the Township of Laurentian Valley.
