NOTICE OF THE PASSING OF A ZONING BY-LAW BY
THE CORPORATION OF THE TOWNSHIP OF LAURENTIAN VALLEY
 
TAKE NOTICE that the Council of the Corporation of the Township of Laurentian Valley passed
By-Law No. 2017-11-050 on the 21st day of November, 2017, under Sections 34 and 36 of the Planning Act, R.S.O. 1990, c.P.13.
 
PURPOSE, EFFECT & LOCATION OF ZONING BY-LAW AMENDMENT (Application File No. Z-2017-07)
The purpose of the amendment is to rezone lands to permit the construction of a single detached dwelling within 58 metres of lands zoned Extractive Industrial Reserve (EMR).  A minimum 150 metre setback from lands zoned EMR is currently required in the General Provisions of the Zoning By-law.  The subject lands are the proposed severed lot in County of Renfrew Application for Consent File No.B19/17, which has received conditional approval from the County of Renfrew Land Division Committee.   The retained lot is known municipally as 2382 B-Line Road.
 
The effect of the amendment is to establish a Rural-Exception Seventy-Two (RU-E72) zone with a special provision to permit a residential dwelling to be constructed with a minimum 58 metre setback from lands zoned Extractive Industrial Reserve (EMR), and to rezone the subject lands from Rural (RU) to Rural-Exception Seventy-Two-holding (RU-E72-h).  The holding zone will establish the principle of development for the property but will remain in place until the conditions for removal of the holding symbol as established by resolution of Council have been met.  The conditions would include the finalization of the consent process to create the severed lot and the entering into of an Agreement with the Township to be registered on title to advise future purchasers of the potential for impacts from future aggregate operations in the area including noise, dust and vibration.
 
The lands affected by the Amendment are located on B-Line Road within Part Lot 23, Concession B, geographic Township of Alice, in the Township of Laurentian Valley, as shown on the Key Map.
 
EFFECT OF PUBLIC CONSULTATION ON DECISION
No oral submissions were made at the Public Meeting.  Written submissions were received on the application prior to the public meeting with the effect being the addition of an additional clause to be added to the Agreement to be registered on title to the property being required as one of the conditions for removal of the holding symbol established by resolution of Council.  The clause requires the owner and future owners to be advised and to acknowledge that Council may approve a reciprocal reduction to the setback to 58 metres for a gravel pit from the proposed dwelling.
 
AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing no later than 4:00 p.m. on WEDNESDAY DECEMBER 13th, 2017, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $300.00 payable to the Minister of Finance by certified cheque or money order.  The appeal must also be accompanied by the completed OMB appeal form.  If you wish to appeal to the Ontario Municipal Board, a copy of an appeal form is available from the OMB website at www.omb.gov.on.ca or by contacting the Township.
 
A COPY of the amendment and any additional information relating to the Zoning By-law Amendment, is available for inspection during office hours at the Township Office.  Any questions related to the By-law should be directed to Lauree Armstrong, Township Planner.
 
Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board.  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.
 
No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
