NOTICE OF THE PASSING OF A ZONING BY-LAW BY

THE CORPORATION OF THE TOWNSHIP OF LAURENTIAN VALLEY

TAKE NOTICE that the Council of the Corporation of the Township of Laurentian Valley passed

By-Law No. 2017-06-025 on the 20th day of June, 2017, under Sections 34 and 36 of the Planning Act, R.S.O. 1990, c.P.13.

PURPOSE OF ZONING BY-LAW AMENDMENT (Application File No. Z-2017-05)

The purpose of the amendment is to satisfy conditions of consent approval for County of Renfrew Consent Application File No.s B87/16, B88/16 and B89/16 by rezoning several parcels of land that are being consolidated for future development purposes and one new lot occupied by an existing single detached dwelling that is being severed. The zoning by-law amendments also satisfy conditions of approval for the consent as required by the Ministry of Transportation and the Township of Laurentian Valley. For ease of description, the amendments are divided into three items.

EFFECT AND LOCATION OF ZONING BY-LAW AMENDMENT (Application File No. Z-2017-05)

The lands affected by the Amendment include three existing properties currently described as Part Lots 22 and 23, Concession 2, FAL, in the geographic Township of Pembroke and known municipally as 1112 Pembroke Street East; Part Lot 21, Concession 2, FAL, in the geographic Township of Pembroke; and Part Lot 21, Concession 2, FAL, in the geographic Township of Pembroke and known municipally as 40 Robinson Lane, and further described in the description of the effect of each Item in the Amendment as follows:

ITEM No. 1

The effect of Item 1 is to establish an Urban Reserve-Exception Two (UR-E2) zone with zone provisions requiring a minimum lot area of 36 hectares and a minimum road frontage of 71 metres and to rezone the subject lands from Limited Service Residential (LSR), Urban Reserve (UR) and Urban Reserve-Exception One (UR-E1) to Urban Reserve-Exception Two-holding (UR-E2-h).

The lands affected by Item 1 include Parts 1, 6, 7, 9, 10, 15, 16 and 17 on Plan 49R-18943, Part of Part 1 on Plan 49R-15387 and are as shown as Item 1 on the Key Map. The Item 1 lands are the retained lands in Consent File No. B89/16, and the severed lot addition lands in Consent Application File No.s B87/16 and B88/16.

ITEM No. 2

The effect of Item 2 is to amend the provisions of the Urban Reserve-Exception One (UR-E1) zone to add a minimum lot frontage requirement of 20 metres and a minimum lot area of 1.4 hectares and to rezone the subject lands from Urban Reserve-Exception One (UR-E1) to Urban Reserve-Exception One-holding (UR-E1-h).

Lands affected by Item 2 include Parts 2, 3, 4 and 5 on Plan 49R-18943 and Parts 4 and 5, on Plan 49R-15387, including the existing dwelling known as 1112 Pembroke Street East (Provincial Highway 148) and are as shown as Item 2 on the Key Map. The Item 2 lands are the severed new lot in Consent Application File No. 89/16.

ITEM No. 3

The effect of Item 3 is to establish a Residential One-Exception Thirty-Five (R1-E35) zone with a minimum lot frontage requirement of 40 metres and a minimum lot area of 7830 square metres and to rezone the subject lands from Limited Service Residential (LSR) to Residential One-Exception Thirty-Five (R1-E35).

The lands affected by Item 3 include Part 8 on Plan 49R-18943 (40 Robinson Lane) as shown as Item 3 on the Key Map. The Item 3 lands are the retained lands in Consent Application B88/16.

All of the lands being rezoned will be subject to a holding symbol with the conditions for removal of the holding symbol including the dedication of lands to the Township for an extension of Robinson Lane, the entering into of an Agreement with the Township related to the extension of Robinson Lane and the construction of the extension to full municipal standards and to address other conditions of the Ministry of Transportation related to access and future development of the lands in Item 1.

EFFECT OF PUBLIC CONSULTATION ON DECISION

All written and oral submissions received on the application were considered in the decision-making process and a minor change was made to the By-law as originally proposed to correct include Part 16, 49R-18943 as part of the lands to be rezoned to Urban Reserve-Exception Two-holding (UR-E2-h) as described above in Item 1.

AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing no later than 4:00 p.m. on July 11th, 2017, a notice of appeal with the Clerk of the Corporation of the Township of Laurentian Valley, which must set out the reasons for the appeal and must be accompanied by the prescribed fee of $300.00 payable to the Minister of Finance by certified cheque or money order. The appeal must also be accompanied by the completed OMB appeal form. If you wish to appeal to the Ontario Municipal Board, a copy of an appeal form is available from the OMB website at www.omb.gov.on.ca or by contacting the Township.

A COPY of the amendment and any additional information relating to the Zoning By-law Amendment, is available for inspection during office hours at the Township Office. Any questions related to the By-law should be directed to Lauree Armstrong, Township Planner.

Only individuals, corporations and public bodies may appeal a by-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Municipal Board, there are reasonable grounds to add the person or public body as a party.
