NOTICE OF APPLICATION FOR ZONING BY-LAW AMENDMENT
AND NOTICE OF PUBLIC MEETING

TAKE NOTICE that pursuant to the requirements of Section 34(10.7) of the Planning Act, R.S.O. 1990, c.P.13, as amended, the Corporation of the Township of Laurentian Valley advises that an application for amendment to Comprehensive Zoning By-law No. 08-04-391 of the Township of Laurentian Valley has been received and was deemed to be a complete application pursuant to the requirements of the Planning Act.  AND FURTHER, TAKE NOTICE that the Corporation of the Township of Laurentian Valley will hold a PUBLIC MEETING ON TUESDAY, SEPTEMBER 17th, 2019 at 5:30 p.m. at the Township Municipal Office at 460 Witt Road, to consider the proposed amendment to Comprehensive Zoning By-law No. 08-04-391 of the Township of Laurentian Valley.  The amendment has been prepared in accordance with the provisions of Section 34 of the Planning Act, R.S.O. 1990, c.P.13, as amended.

PURPOSE & EFFECT OF ZONING BY-LAW AMENDMENT (File No. Z-2019-05)

The purpose of the amendment is to rezone lands to permit the construction of a single detached residential dwelling closer to potential aggregate resources than 150 metres and to more accurately reflect the location of an existing creek/wetland and potential aggregate resources on the property.

The effect of this amendment is described as follows:

Item 1:   To rezone the lands from Extractive Industrial (EMR) and Rural (RU) to Environmental Protection (EP) as shown as Item 1 on the proposed Zoning Map Schedule, to better reflect the location of the existing creek/wetland.

Item 2:   To rezone lands from Extractive Industrial (EMR), Environmental Protection (EP) and Rural (RU) to Rural-Exception Seventy-Six (RU-E76) as shown as Item 2 on the proposed Zoning Map Schedule and establish a Rural-Exception Seventy-Six (RU-E76) Zone with special provisions that include the following: (i) a minimum setback of 50 metres for a new residential dwelling from lands in an Extractive Industrial Reserve (EMR) Zone and a minimum setback of 50 metres for a gravel pit from lands zoned RU-E76; and (ii) a 30 metre buffer area adjacent to the Environmental (EP) Zone to be maintained substantially in a natural vegetated state.

Item 3:   To rezone lands from Environmental Protection (EP) to Extractive Industrial Reserve (EMR) as shown as Item 3 on the proposed Zoning Map Schedule to better reflect the location of the potential aggregate resources.

The lands affected by the Amendment are known municipally as 918 Lubitz Road, and are located in Part 2 on 49R-2700, Part 1 on 49R-4152, and within Part Lot 14, Concession 12, and part of (former) road allowance in Lot 14 between Concessions 12 and 13, in the geographic Township of Alice, in the Township of Laurentian Valley.
