NOTICE OF APPLICATION FOR ZONING BY-LAW AMENDMENT

AND NOTICE OF PUBLIC MEETING

 

TAKE NOTICE that pursuant to the requirements of Section 34(10.7) of the Planning Act, R.S.O. 1990, c.P.13, as amended, the Corporation of the Township of Laurentian Valley advises that an application for amendment to Comprehensive Zoning By-law No. 08-04-391 of the Township of Laurentian Valley has been received and was deemed to be a complete application pursuant to the requirements of the Planning Act. AND FURTHER, TAKE NOTICE that the Corporation of the Township of Laurentian Valley will hold a PUBLIC MEETING ON TUESDAY, June 20, 2017 at 5:30 p.m. at the Township Municipal Office at 460 Witt Road, to consider the proposed amendment to Comprehensive Zoning By-law No. 08-04-391 of the Township of Laurentian Valley. The amendment has been prepared in accordance with the provisions of Sections 34 and 36 of the Planning Act, R.S.O. 1990, c.P.13, as amended.

 

PURPOSE, EFFECT & LOCATION OF ZONING BY-LAW AMENDMENT (Application File No. Z-2017-06)

The purpose of the amendment is to rezone lands to satisfy conditions of approval for County of Renfrew Application for Consent File No. B99/16. The proposed severed lot is occupied by an existing dwelling that is surplus to the needs of the owner who is a farmer with additional lands in the area. As the area of the farm property which is occupied by the existing dwelling is zoned Extractive Industrial Reserve (EMR) an amendment is required to rezone the area of the severed lot to recognize the location of the existing dwelling and to identify that those lands are not suitable for extraction. The retained lot is required to be rezoned to prohibit residential uses on the agricultural lands and to prohibit the existing structures which are used for equipment storage from being used for livestock or manure storage in the future due to their proximity to the surplus farm dwelling.

 

The effect of the amendment is to establish an Agriculture-Exception Twenty-Two (A-E22) zone to prohibit residential uses and to rezone the area of the retained lot that is currently zoned Agriculture (A) to Agriculture-Exception Twenty-Two-holding (A-E22-h). The effect of the amendment is to also establish an Extractive Industrial Reserve-Exception Three (EMR-E3) zone to prohibit the use of the existing structures on the retained for Livestock or Manure Storage and to rezone the area of the retained lot that is currently Extractive Industrial Reserve (EMR) to Extractive Industrial Reserve-Exception Three-holding (EMR-E3-h) . The effect of the amendment is also to establish a Rural Residential-Exception Eleven (RR-E11) zone with special provisions to recognize the existing dwelling and establish a reduced setback for a dwelling from lands zoned Extractive Mineral Reserve (EMR) and to rezone the severed lot from Extractive Mineral Reserve (EMR) to Rural Residential-holding (RR-E11-h).

All of the subject lands are being rezoned to a holding zone where the principle of development would be established by this Amendment but the holding symbol would remain in place until the conditions for removal of the holding symbol as established by resolution of Council are met, including the entering into of a Development Agreement with the Township to provide notice related to the agriculture and potential aggregate uses in the area and to reinforce the prohibition on the use of the existing structures on the retained for livestock or manure storage.

The lands affected by the Amendment are located at 23 Mud Lake Road (County Road No.19) within Part Lots 4 and 5, Concession 1, geographic Township of Pembroke, in the Township of Laurentian Valley, as shown on the Key Map.

COPIES of the proposed amendment, material provided under Section 34 (10.1) of the Planning Act and any additional information relating to the proposed Zoning By-law Amendment (Application File No. Z-2017-06), are available for inspection during regular office hours at the Township Office. Questions related to the application should be directed to Lauree Armstrong, Township Planner.

ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of or in opposition to the amendment aforesaid. If a person or public body does not make oral submissions at a public meeting or make written submissions to the Township of Laurentian Valley before the by-law is passed, the person or public body is not entitled to appeal the decision of the Township of Laurentian Valley to the Ontario Municipal Board.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Township of Laurentian Valley before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.

Please note the following changes to the Planning Act and its Regulations:

If you wish to be notified of the decision of Township of Laurentian Valley on the proposed zoning by-law amendment, you must make a written request to Township of Laurentian Valley c/o Lauree Armstrong, Township Planner.

If you are receiving this notice because you are the owner of property in the area of the amendment that contains seven or more residential units, you must also post this notice in a location that is visible to all of the residents of your property.
