In the matter of Section 45.(1) of the Planning Act, R.S.O. 1990, as amended, Comprehensive Zoning By-law 08-04-391 of the Township of Laurentian Valley and an application by Vincent and Patricia King, the property owners, for a Minor Variance requesting relief from Section 5.2 d) (iii) of the R1 zone provisions, to allow for an addition to an existing dwelling with a minimum exterior side yard width of 1.7 metres reduced from the minimum requirement of 6 metres.

Location of the Property:    Known municipally as 522 Roy Street, described as Lot 84, Plan 402,                                                 geographic Township of Stafford in the Township of Laurentian Valley

Decision:

1.         (   ) Pursuant to Section 45 of Planning Act, R.R.O. 1990, as amended, the request is hereby             refused.

2.         (X) Pursuant to Section 45 of the Planning Act, R.S.O. 1990, as amended, the request is             hereby granted.

3.         (  ) Pursuant to Section 45 of the Planning Act, R.S.O. 1990, as amended, the request is             hereby granted pursuant to Section 45.(9) permission is granted subject to the following             conditions:

 

Reasons:        The proposed variance is minor; it meets the intent of the Official Plan and Zoning By-law and is desirable for the appropriate use of the property as outlined in the attached Planning Memorandum to the Committee dated May 9, 2018. No negative impacts have been identified.

AND TAKE NOTICE that pursuant to Section 45.(12) of the Planning Act, R.S.O. 1990,c.P.13, as amended, the applicant, the Minister of Municipal Affairs and Housing or any other person or public body who has an interest in the matter may appeal to the Local Planning Appeal Tribunal (LPAT)  in respect of the Minor Variance by filing with the Secretary-Treasurer of the Committee of Adjustment/Clerk of the Corporation of the Township of Laurentian Valley not later than Monday the 4th day of June, 2018, a notice of appeal, including the completed Tribunal appeal form, setting out the objection to the decision of the Committee and the reasons in support of the objection.  The appeal must be accompanied by the prescribed fee of $125.00 payable to the Minister of Finance by certified cheque or money order.  If you wish to appeal to the Local Planning Appeal Tribunal (LPAT), a copy of an appeal form is available from the Tribunal website at www.elto.gov.on.ca or by contacting the Township. Only individuals, corporations and public bodies may appeal a minor variance to the Tribunal.  A notice of appeal may not be filed by an unincorporated association or group.  However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group.
